Compensation

Hello, could the CC please confirm the compensation owned by Billy for missing GP.

For clarification:

Billy finished 3rd overall.
His pick won the lottery, moving it from 3rd to 1st overall. Since he missed GP, the pick was moved back to 2nd overall.
I have owned the pick since Jan 2014.
According to the new CBA amendment, here is the compensation:
3- Compensation owed by the offending GM to the owner of the diminished first rounder*

- If the pick is moved 2 or less spots:
and the pick is #1, a first round selection in this same draft
and the pick is #2-5, a 2nd and a 3rd round selection (this draft year or next)
and the pick is 6+, a 2nd round selection
if the offending GM doesn't own the compensatory picks he will have to acquire them on the market

- If the pick is moved more then 2 spots:
and the pick is #1-5, the league will also compensate the GM with a pick between the 1st and 2nd round (30b)
and the pick is 6+, the league will also compensate the GM with a pick between the 2nd and 3rd round (60b)

*Obviously point #3 depends on when the owner of the pick acquired it. If the pick is acquired at the end of the season, or when its team is already on par of missing gp, #3 will not apply, as the owner acquired an asset (the pick) that already had diminished value at the time of the deal.
Points #3 also work as sanctions for the GM responsible of missing gp. If the pick is traded at a time that voids #3, instead of sanctions you would have decreased value of the pick already affecting the offending GM in the deal.
According to this, the compensation should be a 2015 1st round pick. I would like to confirm this as well as the date of when compensation is due.

In my opinion. In short. We fucked up this year. And ultimately you have already benefited from this. Now if we are committing to this fuck up, I suppose logically you could continue to further benefit from this, but personally I wouldn't advocate the continuation of the bleeding from this.

I definitely think within our new GP adjustment formula, it makes absolutely zero sense, and simply does not work, to make the adjustment post-lottery if the pick wins. So I think you have already gotten a huge boost by getting Eichel instead of Marner, pushing for the 1st as well seems like unnecessary bleeding toward bills. And this absolutely needs to be cleared up going forward.

I'm not asking for anything unfair, simply what has been documented. I see no point in making rules if we deviate from them at every opportunity.

From my point of view, I am losing out on McDavid. Should I not be compensated as stated in the rules?

Mik will be able to give a better explanation than this as its all purely speculation on my behalf. But I would think when Mik and whoever else on the CC set up the new rule surrounding set penalties for GP offenses, the penalties were set in breadths based on where a pick would land at the end of the season, and the possibility of the adjustment being made post-lottery to a lottery winning pick, either wasn't fully considered or wasn't the intention of the rule to apply in that specific rare scenario. That being said, the way the rule was laid out, it definitely seems that you are entitled to a first.

But at the same time I feel as if we are dividing by zero for this entire situation, as within that framework of GP adjustment, the amount of spots that the pick moves back is completely based on its points in the standings and how many spots the adjustment roles it back, something that can not be done if a pick wins the lottery. Then in the heat of the moment, it seems the CC made a rushed decision that didn't take this into consideration, and seemed to revert back to what had been done in previous seasons as "penalty after lottery and move back one spot for GP offenses" which is already breaking the rule set out by Mik in the league announcements, as its simply a scenario that does not work within the adjustment formula. Why was it only one spot rolled back? Why not 2? There's no way to apply the adjustment post lottery if it wins.

I know in both our opinions we thought that the adjustment should have been done pre-lottery, its not what happened. You wouldn't have gotten McDavid in that scenario either. But yea this is definitely one for the CC to sort out, it is really messy as is right now.

If I was making the decision. I would recognize the unclarity of a lack of updated CBA we have had and the mess its made here, waive the penalty to billy, and award you the 31st overall and push everything else back. And make this rule damn clear going forward.

That would be an amicable solution, but I don't think Billy should escape unscathed.
